Put down the bottle, and put up your hands – that cold beer you’re clutching could be illegal.

Aluminum beer bottles – an increasingly popular item at New York‘s bars and ballparks – are technically illegal under the state’s 1982 Bottle Law, though almost no one knew it.

“It is not so much that the aluminium bottles were illegal, it is the caps,” explained state Sen. Mark Grisanti (R-Buffalo).

A little-noticed provision of the law requires metal beverage containers to include nondetachable caps.

It was intended to outlaw the old-fashioned pull-tab beer cans, which were considered a hazard to the environment and harmful to animals who ingested the discarded tabs.

Nobody envisioned the advent of aluminum bottles decades ago. “It was an unintended consequence,” Grisanti said.
