Booze NewsA court decision in favor of a West Side co-op building is sending shivers through New York’s nightclub and restaurant industry.
In ruling that a roof-deck bar at the Empire Hotel exceeded a city ordinance for noise level and interfered with the residents’ “right to use and enjoy their respective apartments,” the New York appellate court on Aug. 24 reversed a lower court’s decision and sent it back to that court to recommend a remedy.
