Second Circuit Serves Up Twist in Stoli Vodka Litigation

Consider the fight over U.S. rights to the famed Stolichnaya trademark both shaken and stirred after an appellate ruling Friday.

As previously reported in The Am Law Litigation Daily, a three-judge panel of the U.S. Court of Appeals for the Second Circuit vacated a March 2006 ruling in which a Manhattan federal district court judge dismissed trademark, misappropriation, and unfair competition claims by a Russian government-owned entity called Federal Treasury Enterprise Sojuzplodoimport (FTE). Although the Second Circuit panel affirmed the lower court’s dismissal of fraud and unjust enrichment claims against the beverage companies Allied Domecq and SPI, its ruling revives a case that Russia considers a matter of national pride.
